I. SUBJECT

1. The Terms of Use govern the relationship between the Merchant and the users of the online store https://shop.iridacenter.bg, arising from the provision and use of the website and the services offered on it and on-site at the Irida Laser Aesthetic Center. The Terms of Use are available on the website, and every User can familiarize themselves with them.

II. TERMINOLOGY

When interpreting and applying these general terms and conditions, the terms and expressions used below have the following meanings:

2. "User/Client" refers to anyone who has accessed the website https://shop.iridacenter.bg on their computer or mobile device and/or uses the goods/services offered on it.

"Merchant" refers to the owner of the online store https://shop.iridacenter.bg, namely the company Gertom Ltd., with UIC 208148217, registered office address: Sofia, Druzhba residential complex, Block 280, and business address at Irida Laser Aesthetic Center: Sofia, Druzhba residential complex, Block 285, entrance A, store 5.2. Contact phone: 0878856671, email: gertomltd@gmail.com.

4. "Online Store" refers to the website https://shop.iridacenter.bg and all subpages of the same domain owned by the Merchant.

5. "Order" refers to the request to purchase goods/services from the online store under the conditions provided therein regarding delivery and payment methods by the User/Client.

6. "Service" is any action by the Merchant in relation to an order placed by the User/Client regarding the offerings on the online store.

7. "Voucher" refers to a personalized document issued by the Merchant, which the User/Client receives electronically or on paper, confirming that they have paid for the service offered by the Merchant and can therefore use it.

III. GENERAL PROVISIONS

8. This document contains the General Terms under which the Merchant provides services to its users through the online store. The services are offered and can be purchased and used under the condition that the User/Client unconditionally accepts the terms mentioned in this document. These terms are binding for all users. By ticking the option "I have read and agree to the Terms of Use and Privacy Policy," the User agrees, fully accepts, and undertakes to comply with these General Terms.

9. The prices of the Services are in Bulgarian lev (BGN) including VAT.

10. The identification of the User/Client for the purpose of reproducing their statement of acceptance of the General Terms and for the placed order is carried out through the IP address stored in the log files on the server of https://shop.iridacenter.bg, as well as any other information.

11. The services listed on the online store do not constitute a legally binding offer but are a demonstrative online catalog describing the Merchant’s product line.

12. By clicking the "Complete" button, users agree to purchase the goods/services in their "Cart." This action has a legally binding effect, and as a result, it is considered that a distance sales contract has been concluded. The Client receives confirmation of the order at the email address they provided.

13. The services offered on the online store can only be ordered by individuals who have reached the age of majority (18 years old).

14. The services offered on the online store can be used by minors only with written permission and in the presence of their parents/guardians or legal representatives, and only if the service allows it.

15. The contractual language is Bulgarian, and payments will be made in Bulgarian lev (BGN) including VAT.

16. All photos and video materials published on the site are copyrighted, and their use without the written consent of the author is a violation of the Copyright and Related Rights Act.

17. The User/Client has the right to be informed about the status of their order.

18. The User/Client agrees that the Merchant may access their personal data for technical purposes in fulfilling obligations related to providing the goods/services.

19. The User/Client is obliged to pay for their order according to the chosen payment method.

20. The User/Client undertakes to use the services in compliance with the following conditions:

- Not to violate and to respect the fundamental rights and freedoms of citizens and human rights, according to the Constitution and laws of the Republic of Bulgaria and recognized international acts.

- Not to damage the good name of others and not to incite violent changes to the constitutional order, the commission of a crime, violence against individuals, or racial, national, ethnic, or religious hatred.

- Not to infringe on other people's property or non-property, absolute or relative rights and interests, such as ownership rights, intellectual property rights, etc.

- To comply with Bulgarian legislation, copyright law, applicable foreign laws, moral standards, good practices, and Internet etiquette when using the services provided by the Merchant.

- To immediately notify the Merchant of any violation found when using the services.

- Not to upload, send, transmit, distribute, or use in any way and not to make available to third parties software, computer programs, files, applications, or other materials containing computer viruses, unauthorized remote control systems (“Trojan horses”), computer codes, or materials designed to interrupt, hinder, disrupt, or limit the normal functioning of computer hardware or software or telecommunication facilities, or intended for unauthorized intrusion or access into foreign resources or software.

- Not to perform malicious actions.

- To indemnify the Merchant and all third parties for all damages and lost profits, including any costs and attorney fees incurred due to claims made and/or compensations paid to third parties in connection with web pages, hyperlinks, materials, or information that the User has used, placed on the server, sent, distributed, made available to third parties, or made accessible through https://shop.iridacenter.bg in violation of the law, these General Terms, good morals, or Internet etiquette.

V. PAYMENT METHODS FOR SERVICES, VOUCHERS, AND THEIR DELIVERY

31. The Merchant accepts electronic payments via bank cards bearing the trademarks Visa, Visa Electron, V Pay, Mastercard, Maestro, American Express, Apple Pay, and Google Pay in compliance with the requirements for card payments in electronic commerce.

32. The delivery of vouchers is carried out by courier or electronically to the physical address provided by the User/Client (within five business days from the voucher purchase) or email (within 48 hours from the voucher purchase). The User/Client bears the full risk of non-receipt of the goods/services electronically due to incorrectly provided information. The Merchant is not responsible for delays or inability to deliver electronically due to technical or other reasons beyond their control.

VI. SERVICE DELIVERY

33. The client who placed an electronic order for a service is responsible for downloading and reviewing the terms of use for the respective service, which were sent to them by the Merchant to the email address they provided, and for passing them on to the end user.

34. Vouchers are personalized and can only be used by the person whose name is printed on the voucher, except in cases of refusal to use and transfer of the voucher, as described below in sections 43, 44.

35. The specific terms for using different services are provided by the Merchant, and the service must be used in accordance with them.

36. Services are provided after a reservation has been made according to the Merchant's outlined procedure, and upon presentation of a voucher (either in paper or electronic form) and an identity document.

37. The service provider has the right to refuse to deliver the service if the documents described in point 36 are not presented, or if their authenticity is questioned, as well as to cancel the delivery of the service due to unforeseen or extraordinary circumstances.

VII. SERVICE RESERVATIONS

38. The user/client must book an appointment by calling the Laser Esthetic Center IRIDA at 0878856671, online at https://book.iridacenter.bg, or by email to info@iridacenter.bg, to use the purchased service within 60 days from the date of purchase of the voucher and must utilize it within 120 days from the date of purchase of the voucher. Instructions for booking an appointment are also provided in the notification email accompanying the voucher.

39. Reservations are subject to the availability of Laser Esthetic Center IRIDA and must be made according to the serial number of the valid voucher.

40. A reservation for the service is considered confirmed/created after the client's request and the fixed date and time provided by the Merchant, either electronically or through a phone call between both parties and/or email provided by the client.

41. A confirmed/created reservation can be canceled at least 24 hours or more before the event and no more than two times. After the third cancellation of a booked appointment, the Merchant has the right to refuse to fulfill its obligations.

42. Reservations with expired vouchers are not accepted. Such vouchers are invalid, and the services associated with them cannot be used.

VIII. POLICY ON CANCELLING PURCHASED SERVICES, TRANSFERRING USE, AND EXCHANGING SERVICES

43. The user/client has the right to cancel the distance contract and the use of the service without providing a reason and without owing compensation or a penalty to the Merchant. In this case, the Merchant does not refund the paid amount but offers the user/client the option to transfer the use of the paid service to a third party or exchange it for another under the following conditions:

44. The user/client has the right to transfer the use of the voucher to another person within 14 calendar days from the date of purchase of the voucher, provided that this request is submitted in writing via email to info@iridacenter.bg, detailing the voucher's information and the new recipient’s details. The user/client must fill out, sign, and send a scanned Declaration of Voucher Transfer, provided by the Merchant electronically. The transfer is considered valid only after written confirmation from the Merchant.

45. The user/client has the right to exchange the purchased service for another within 20 days from the date of purchase of the voucher, provided that this request is submitted in writing via email to info@iridacenter.bg, detailing the voucher's information and the desired exchange. The user/client may exchange the purchased service for another of equal or higher value. The user/client must pay the difference in value during their visit after scheduling the appointment.

46. A cancellation or exchange of a service as per points 43 and 45 is not possible after a reservation has been made for the service.

IX. VOUCHER VALIDITY

47. The validity of each voucher is described in the email received by the client upon purchase, or if provided on paper, the validity is printed on the paper voucher.

48. Each voucher can be used within its validity period. Services linked to expired vouchers will not be provided!

XII. PERSONAL DATA

49. The Merchant guarantees the confidentiality of the provided information and personal data – name, phone number, gender, and email. This data will not be used, shared, or disclosed to third parties except as specified in these Terms and Conditions. The Merchant protects the personal data of the user/client disclosed during the online purchase application, unless the client has provided false data. In compliance with applicable laws and these Terms and Conditions, the Merchant may only use the client's personal data for purposes defined in the contract. Any other use of the data will comply with Bulgarian legislation, applicable international acts, internet ethics, moral rules, and good practices.

50. The Merchant commits to not disclose any personal data of the client to third parties – government authorities, commercial entities, individuals, etc., except when explicit written consent is obtained from the client, or when the information is required by authorized governmental officials according to the applicable laws. The Merchant is obligated to provide the information as required by law.

XIII. CHANGES

51. These Terms and Conditions may be changed at any time by the Merchant, who has the right to alter the characteristics of the provided services and these Terms and Conditions based on changes in legislation. The Merchant commits to notify the user of any changes to the Terms and Conditions by posting a notice on its website and giving a reasonable period to review them. If the client does not object within this period, they are considered bound by the changes. If the client objects within this period, the Merchant has the right to immediately stop or terminate the provision of services to the client.

XIV. DISPUTES

52. All disputes between the parties will be resolved in the spirit of understanding and good faith. If an agreement cannot be reached, any unresolved disputes, including those arising or relating to the interpretation, invalidity, performance, or termination of this contract, as well as disputes over filling gaps in the contract or adapting it to new circumstances, will be resolved by the competent court according to the Merchant's registration, in accordance with Bulgarian legislation.

XV. INFORMED CONSENT FOR SERVICE DELIVERY

53. Using services offered in the online store requires mandatory familiarization with the content of the Informed Consent for the selected service and acceptance of its terms. The user/client can review the Informed Consent for the selected service in the Terms and Conditions below and during the completion of the online form for purchasing services.

54. The user/client must familiarize themselves with the Informed Consent and comply with its requirements, confirming this during the online form completion.

55. The user/client must familiarize themselves with the Informed Consent, fill it out, and sign it immediately before the service is provided, as mentioned in section 21 of the Terms and Conditions.
